Requests from authorities and transparency

Last update

Version

To whom it applies
Customers, data holders and requesting authorities

In summary

  • We demand a valid and well-founded order: an informal request does not get data.
  • We notify the client before we deliver, except for express legal prohibition.
  • We deliver the minimum that the order requires, not everything we have on that person or vehicle.
  • We publish a transparency report with the number of requests received and received.

This summary guides the reading and does not replace the text of the document.

01The starting point

The fleet data are from our customers, not ours. In a requirement, our default position is to direct the authority to the data manager, who can evaluate it with knowledge of its operation. We only deliver directly when the order forces us and does not admit that derivation.

We collaborate with justice. Collaborating does not mean delivering without examining: a delivery made without verifying the validity of the order is a filtration in official format.

02What do we demand to respond?

  1. 1.Written order of competent authority, with identification of the issuer and the file.
  2. 2.The express legal basis of the faculty that is invoked.
  3. 3.The precise identification of which data are requested, on which persons or vehicles and in which temporary window.
  4. 4.A formal way of receiving verifiable. A mail without signature or backup does not start the procedure.

If the order is too broad, ambiguous or unsubstantiated, we object to it or ask for its accuracy before we deliver anything, and we record the exchange.

03How we process it

  1. 1.Registration of the application with date, issuer, scope and basis.
  2. 2.Legal review of jurisdiction, validity and proportionality.
  3. 3.Notification to the client concerned, so that he can exercise his own rights and resources.
  4. 4.Traction strictly bound to the order, with a review of not carrying data from non-covered third parties.
  5. 5.It delivers by safe channel, with record of what it was delivered and to whom.
  6. 6.Full, auditable file maintenance.

When we can't tell

If the resolution expressly prohibits informing the client, we do not. In that case we record the prohibition, its basis and its time limit, and notify the client as soon as the restriction is lifted.

04Transparency report

We will publish the number of requests received on a biannual basis, how many were fully or partially met, how many had been rejected or objected, and how many times we could not notify the client.

Drometra has not received requests for authority at the date of this publication. The table is maintained even if the result is zero: a report that only appears when there is something to report does not allow to notice its absence.
