- Version
- 4.0
- To whom it applies
- Site visitors, business contacts, platform users, and people whose data our customers process
In summary
- It covers the data we process on our own behalf —website, sales contact, support, and account administration— and explains our position regarding fleet data, which we process on behalf of each customer.
- The platform is hosted on a Contabo GmbH server located in France (European Union); backups are encrypted before leaving the server and are stored in Cloudflare R2.
- Michiva may use OpenAI or Anthropic models via API, with training prohibited, zero retention when the provider offers it, license plates and names masked, and no automated decisions with effects on people.
- Drometra provides operational information; it does not make financial decisions or provide financial, tax, accounting, investment, legal or medical advice. Michiva's new functions, such as alerts or messages to recipients, are described in its own document and are turned on only at each company's request.
- The site does not set analytics or advertising cookies. We do not sell personal data.
- You can exercise access, rectification, erasure, objection, portability, and blocking; we respond within 30 calendar days.
This summary guides the reading and does not replace the text of the document.
01Who processes your data
The data controller is DROMETRA SpA, RUT 78.506.876-9, a company incorporated in Chile, with its registered address at Colo Colo 379, Oficina 706, Edificio Amanecer, Concepción, Región del Biobío, Chile. The contact email is [email protected].
- Privacy inquiries and exercise of rights: [email protected]
- Security reports: [email protected]
- Data protection delegate: being appointed before December 1, 2026; in the meantime, inquiries are handled at the same email address.
02Scope: when we are responsible and when we are in charge
Drometra treats personal data in two different legal positions, and the distinction determines who you claim and who decides on such data.
| Status | Our position | Who decides? | Applicable document |
|---|---|---|---|
| You browse the site, request a demo, write to support, receive communications | Responsible | Drometra | This policy |
| Your employer contracts Drometra and the platform records vehicles, positions, routes, deliveries, or events | Responsible | The client who contracts | Platform privacy notice |
| You manage your company's account on the platform (identifier, email, role, access log) | Responsible | Drometra | This policy |
| You receive an order and open a tracking link, or sign for a delivery | Responsible | The company that ships to you | Platform privacy notice |
| Positions to a position in Drometra | Responsible | Drometra | Privacy notice for candidates |
If you are a driver or worker of a client company and want to know what is recorded about you, the starting point is your employer: he defines the purposes. However, we help you channel the application; it is explained in the document on driver data.
03Covered products and their status
Drometra is a set of products that share infrastructure, but they do not process the same data or have the same level of maturity. We publish the status of each one because privacy guarantees depend on what is actually in operation.
| Product | What it is | State | Main personal data | Our position |
|---|---|---|---|---|
| drometra.com website | Sales information, documentation, and contact | Available | Technical connection data and what you write in a form or email | Responsible |
| Platform (console) | Fleet, route, delivery, and tracking management | Available to customers | Company users, drivers, vehicle positions, delivery recipients | Processor (fleet data) and controller (account administration) |
| Michiva | Assistant that answers questions about the customer's operations | Predefined questions available; the language model layer is implemented and disabled by default | The written question and the customer's operational figures | Responsible |
| Dromivia | Android app for drivers in the field | In development; not yet used with real people in production | Driver identity, positions during the route, signatures, photos, name and RUT of the person receiving | Responsible |
| Drometra Vision | Road-facing camera with on-device analysis | Lab beta with access by request | Road video and, incidentally, people and vehicles that appear in it | Responsible |
| Drometra Spaces | Aggregated heat map of in-store attention | Pilot recruiting; no product in operation | By design, only aggregate counts; the video does not leave the store | Responsible |
Products in beta, development, or pilot are governed by a specific agreement with the participant, and are not activated with data of real people without the prior assessment required by law. The specific notices for Dromivia, Drometra Spaces, and Michiva detail each case.
04What data we collect as controller
| Category | Specific data | Where they come from |
|---|---|---|
| Identification and contact | Name, surname, corporate mail, phone, company, charge, country | You provide them in a form, an email, or a sales meeting |
| Account and access | User identifier, role, associated company, registration date, sign-in events, second authentication factor, access IP address | They are generated when using the platform |
| Trade relationship | Quotations, contracts, purchase orders, billing data and company Rut | The sales process and billing |
| Support | Emails, attachments you send, and conversation notes | The support channels |
| Site browsing | IP address, browser, and requested path, in the technical logs of the server and the Cloudflare network; your language and cookie choices, stored in your own browser | Generated when you visit the site. We do not use analytics or advertising tools |
| Security | Access records, authentication events, IP addresses, failed attempts | They are automatically generated and necessary to operate safely |
We do not ask for sensitive data on any form on the site. If you send sensitive data on your own initiative in a support message, we treat them only to answer that query and remove them when it is no longer necessary.
Minors
The site and platform are aimed at companies and people over the age of 18. We do not collect data from minors consciously. If you detect that a minor gave us data, write us down and delete them.
05What do we use them for and what basis of legality
Any treatment operation needs a basis of legality. Act No. 21.719 provides consent as a general rule and admits other grounds when treatment is justified by itself. This is the complete correspondence.
| Purpose | Basis of legality | Data involved |
|---|---|---|
| Answer your request for demo, quote or contact | Pre-contractual measures at the request of the holder | Identification and contact |
| Provide the contracted service and manage your account | Contract performance | Account and access, business relationship |
| Issue tax documents and keep accounts | Compliance with a legal obligation | Trade relationship |
| Support and incidences | Contract performance | Support, account and access |
| Send you marketing communications | Consent, revocable in each shipment | Identification and contact |
| Remember your language and your cookie choice | Technical necessity to deliver the service you request | Site browsing |
| Protect the platform: detection of abuse, fraud and intrusions | Legitimate interest in the safety of the service and its users | Security, site browsing |
| Defend or exercise rights before public courts or bodies | Exercise or defence of rights | The relevant cases |
Ley 21.719 · Articles 12 and 13
Article 12 establishes consent as a general basis, and requires that it be free, informed, specific to its purpose, prior and unequivocal. Article 13 allows treatment without consent when it is based, inter alia, on the fulfilment of a legal obligation, the conclusion or enforcement of a contract, the legitimate interest of the person responsible or the exercise of rights before the courts.
Official text of the ruleWhen we invoke legitimate interest we make a prior weighting between that interest and your rights, and we document it. You can ask us for the result of that weighting and oppose treatment.
06Artificial intelligence and automated decisions
We do not make solely automated decisions that produce legal effects on a person or significantly affect them. We do not score people to decide whether to sell to them, nor do we profile visitors for advertising purposes.
We use models in two places, with different safeguards depending on where they run.
| Where | Which model | Where it runs | What data it receives |
|---|---|---|---|
| Michiva | OpenAI or Anthropic language models, via API, directly or through OpenRouter | On the model provider's infrastructure (United States) | The written question and the facts needed to draft the answer, with license plates and names masked |
| Drometra Vision | Open-source object detection model | On the phone or vehicle device; no video is sent to an external model | Road camera video, processed locally |
When Michiva uses a language model, each call is configured so that the provider does not use the data to train its models and, where the provider offers it for that model, does not retain it. If a model does not support zero retention, the provider may keep abuse-monitoring logs for up to 30 days under its own terms; we will tell you before enabling that model for your company.
The model does not calculate figures: figures come from the database, and a deterministic checker verifies that the drafted text does not alter them. Drometra does not store the text of questions or answers; only a usage log —who asked, purpose, model, result, consumption, and cost— which is deleted after 90 days. Details are in the document on Michiva and model providers.
We do not use your contact details, your support inquiries, or your account content to train models, whether our own or third parties'. Fleet data is not used for training either without a written and revocable agreement with the customer.
07Drometra does not provide financial advice
The platform may display operational and commercial figures: operating costs, billable items, statuses of tax documents, and summaries drafted with the help of a model. That information is descriptive and helps your company understand its operations.
- Drometra does not make financial, credit, investment, or payment decisions for you or your company.
- Drometra does not provide financial, tax, accounting, investment, or legal advice, and nothing the platform displays —including text generated by Michiva— constitutes a professional recommendation in those matters.
- The decisions you make with that information are yours. For financial, tax, or accounting decisions, consult a licensed professional.
08Who we share them with
We share data only when it is necessary for one of the declared purposes, and always under contract that imposes confidentiality and purpose limitation.
- Providers acting on our own: server hosting (Contabo), network, tunnel, and encrypted backup storage (Cloudflare) and, only when the feature is enabled, language model and transactional email providers. The current list, with location, data received, and status, is in the register of sub-processors.
- Authorities and courts: When there is a valid and well-founded order, how we evaluate it is in the policy of requests from authorities.
- External advisers: lawyers, auditors and accountants, subject to professional secrecy.
- In a corporate operation: If Drometra is involved in a merger or acquisition, the data may be transferred to the acquirer, who is subject to the same policy until he notifies a change.
We don't sell personal data, we don't give them to data brokers and we don't use them for third-party advertising.
09Where and how they are stored
| What | Where | How it is protected |
|---|---|---|
| Platform database, user identity, and map services | Contabo GmbH dedicated server in France (European Union) | TLS-encrypted connections, isolated internal networks, database-level isolation between companies, mandatory second factor |
| Database backups | Cloudflare R2 | Encrypted on our server before upload; Cloudflare does not have the key |
| Public base maps | Cloudflare R2 and its delivery network | They contain no personal data |
| Console sessions | Platform server | Encrypted with AES-256-GCM |
| Data in the Dromivia app and in Drometra Vision | The driver's phone or the vehicle device | Described in the Dromivia notice and in the video document |
| Your language and your cookie choice | Your browser | They do not leave your device, except for the language cookie, which our server reads |
We do not yet have encryption of the database volume on the server; it is under evaluation. We say so because a privacy policy should not promise more than the system does.
10International transfers
Drometra is a Chilean company, but the platform is not hosted in Chile: the main server is in France, in the European Union, whose data protection regime (General Data Protection Regulation) is at least equivalent to Chile's. Cloudflare processes traffic on its global network and is a United States company. When Michiva uses a language model, the question and the masked facts are processed in the United States.
Each transfer is covered by the provider's data processing agreement and contractual clauses. The details per provider, the destination country, and the mechanism are in the international transfers document.
Ley 21.719 · Articles 27 and 28
International transfer is lawful when the country of destination has an adequate level of protection determined by the Agency, when the person responsible adopts contractual clauses, binding corporate rules or other legal instruments that ensure compliance, or when he / she means a certified compliance model.
Official text of the rule11How long we keep them
We retain each category only as long as the purpose that justifies it remains, and then we delete it or irreversibly anonymize it. These are the periods for the data for which we are the controller.
| Category | Deadline | What determines it |
|---|---|---|
| Trade contact without conversion | 24 months from last contact | Sales cycle of the sector |
| Account and access | Contract monitoring + 12 months | Reclation and operational continuity |
| Trade relationship and billing | 6 years | Chilean tax and commercial time limits |
| Support emails | 36 months from closure | Tracability of recurrent incidents |
| Marketing communications | Until you leave. | Removable consent |
| Sign-in events | 1 day | Brute-force attack detection |
| Security and audit records | 12 months as a target | Investigation of incidents |
Some retention periods are applied automatically and others are still applied manually while we finish automating them. The retention policy indicates which is which, and includes the periods for fleet data, which each customer sets by contract.
12Your rights and how to exercise them
Chilean law recognizes a set of very personal rights: they cannot be given up or given up in advance, and they are free of charge.
- Access: know if we treat your data and obtain a copy, together with its origin, purpose, recipients and storage time.
- Rectification: correct inaccurate, outdated or incomplete data.
- Abolition: that we remove your data when they are no longer necessary, you revoke consent or treatment is illegal.
- Opposition: stop treatment based on legitimate interest, and in any case direct marketing.
- Portability: receive in structured electronic format the data you gave us, or ask us to send them to another responsible.
- Blocking: temporarily discontinue treatment while a request for rectification, suppression or opposition is resolved.
They are exercised by writing to [email protected]. We verify your identity before responding —it is a safeguard for you, not a formality— and we respond within 30 calendar days, extendable only once for an equal period when the request is complex, notifying you before the first period expires. Today these requests are handled manually by our team.
Ley 21.719 · Articles 5 to 11
Articles 5 to 9 regulate the rights of access, rectification, suppression, opposition and portability; Article 8b incorporates the temporary blockade; Article 11 sets the period of response at 30 days, which can be extended once.
Official text of the ruleIf we do not respond, or the answer does not satisfy you, you can claim with the Personal Data Protection Agency. That you claim does not exempt us from responding, and we do not admit any form of retaliation for exercising a right.
13How we protect the data
We apply technical and organizational measures proportionate to the risk: encryption in transit on all connections, including the database; mandatory second factor and lockout after repeated access attempts; isolation between companies in the database itself; role-based access control with least privilege; audit logging of actions; unprivileged containers on internal networks; encrypted backups with verified restoration.
If a gap occurs that represents a risk to your rights, we notify the Agency and, where appropriate, the holders concerned, in clear language and without undue delay. The details are in the security statement.
Ley 21.719 · Articles 14 quinquies and 14 sexies
The person responsible takes measures in accordance with the state of the technique, the costs, and the probability and severity of the risks, including pseudonymization, encryption and restoration capacity. Violations are communicated to the Agency by prompt means and without undue delay, and to the holders when they affect sensitive data, of persons under 14 years of age or of economic and financial obligations.
Official text of the rule14Applicable regulatory framework
This policy is governed by Chilean law. When we provide services to customers in other jurisdictions, we also apply the rules that are relevant to this operation.
- Act No. 21.719: it regulates the protection and processing of personal data and sets up the Agency for the Protection of Personal Data. Published on 13 December 2024, it has been in place since 1 December 2026.
- Act No. 19,628: on the protection of privacy, applicable until Act No. 21.719 enters into full force.
- Constitution, article 19 No. 4: it recognizes the protection of personal data as a constitutional guarantee, following the reform of Act No. 21,096.
- Act No. 21.663: framework law on cybersecurity; we are able to operate services to support transport and logistics.
- Act No. 19,496: on the protection of consumer rights, as applicable to procurement.
15Changes in this policy
We publish any new version in this same direction, with its date and version number. When the change substantially alters the purposes, the basis of legality or the addressees, we notify it at least 30 days in advance by mail to the headlines with whom we are related, and - if the law requires it for that change - we ask again for your consent.
Version 4.0 corrects the server location (France, not Chile), removes the site analytics, which were never actually installed, and adds the products, the model providers, and the statement on financial advice.
Status of this document
