Driver data and labour control limits
- Last update

- 2.0
- To whom it applies
- Field drivers and workers, and the customers who use them
In summary
- In Chile, telematics control is lawful when justified by safety or technical requirements, not when it is intended to monitor a person.
- The control must be general and impersonal, in the internal rules and must be known to the workers before being applied.
- Today the Dromivia app records position only during the assigned route, does not request background location permission, and does not use the microphone or a cab camera.
- The platform does not rate drivers, does not recognize faces, and does not make decisions about people: those decisions are always human and made by the employer.
This summary guides the reading and does not replace the text of the document.
01Why do we publish this
The decision on what to measure about a worker is from the employer, not ours. But we build the tool, know its limits and know that most of the conflicts that telematics produces do not come from technology but from setting it up without considering the work framework. To keep it quiet so that the sale is simpler would be to transfer to our client a risk that we see and he does not.
With respect to drivers' data, Drometra acts as processor: it processes the data on behalf of the customer that employs them, following its instructions, and does not use it for its own purposes.
This is not legal advice
This document describes the Chilean framework and what the platform does today. It is not legal advice: each company must validate its case with its own advisers and with its joint health and safety committee (comité paritario) where applicable.
02The framework: what Chilean law says
Labour Code · Article 5, first subparagraph
The exercise of the employer & apos; s powers is limited to respect for the constitutional guarantees of workers, especially when they may affect privacy, privacy or honour.
Official text of the ruleLabour Code · Article 154 bis
The employer must keep a reserve of all the information and private data of the worker to which he or she has access on the occasion of the employment relationship.
Official text of the ruleOn this basis, the Labour Directorate has built a consistent doctrine on the mechanisms of audiovisual control and positioning. Its criteria can be summarized in four cumulative requirements: that the system is objectively justified by technical requirements of the production process or for safety reasons; that it is general and impersonal, and not a follow-up to a person; that the control of the worker's activity is a secondary result and not the purpose; and that it is incorporated into the internal regulations of order, hygiene and safety, and is known to the workers.
As of 1 December 2026, above all, Act No. 21.719, on the basis of legality, the duty of information, minimization, the time limits for conservation and the right to exercise, is superimposed. To comply with the labour framework does not exempt the framework of data protection and vice versa.
03What it means in practice
The table summarizes the usual reading of the framework for the most common uses of telematics. It includes uses that Drometra does not offer today, because the customer may combine our platform with other tools and it is useful for them to know the full criteria.
| Use | Regular reading of the framework | Status at Drometra |
|---|---|---|
| Position of the vehicle or phone during the route, for dispatch and safety | Admissible: is justified by operation and individual control is accessory | Available. Dromivia only sends position between vehicle confirmation and the end of the workday |
| Position outside the day or on the rest day | Not admissible: no work purpose to support it | Dromivia does not request background location permission, and the server rejects positions sent before the route is assigned or more than 15 minutes after it is closed |
| Camera on the way, to rebuild sinister | Admissible for security, with clear access rules | In lab beta (Drometra Vision); see the video and image document |
| Camera to the cabin, to prevent distraction and fatigue | Admissible if its object is safety and not performance evaluation | Not available. Before offering it, we will conduct an impact assessment and a labor review, and we will update this document |
| Cabin audio | Hardly justifiable: reach private and third-party talks | Not available. No module uses the microphone |
| Individual driving score as the basis for a sanction | Risk: is a decision about a person based on an automated calculation | Not available. The platform does not calculate driver scores |
| Facial recognition to identify the driver | It treats biometric data, which the law qualifies as sensitive | Not available. Access to Dromivia is with an account and PIN; fingerprint or face unlock, if the driver enables it, is handled by the phone itself and Drometra never receives that data |
04What the platform records today
This is the data that the Dromivia field app and the console process about a driver. The app's technical details are in the Dromivia privacy notice.
| Date | When it is generated | What for? |
|---|---|---|
| Driver's display name and phone number | When the customer registers them | Assign routes and contact them during operations |
| Access credentials | When signing in to the app | Authenticate the driver; the PIN is stored encrypted on the phone |
| Phone position (approx. every 20 seconds) | Only during the assigned route | Delivery tracking and recipient notification |
| Confirmed vehicle and pre-trip checklist | At the start of the workday | Know which vehicle is operating and in what condition it left |
| Package scanning, delivery photos, and signature | At each stop | Proof of delivery for the customer and its recipient |
| Reason for non-delivery | When a delivery is not completed | Management of retries and claims |
- First name in tracking: the tracking page the recipient receives shows only the driver's first name and an approximate position (the center of a cell of about 300 meters) during the last leg.
- Local diagnostics: the app stores a technical log on the phone of up to 7 days, with no recipient data and with rounded coordinates. It only leaves the phone if the driver decides to share it.
- On sign-out: the workday's positions are deleted from the phone; when the device is unlinked, everything the app stored locally is deleted.
- Human review: no platform feature makes decisions about a driver. Any disciplinary measure is a decision of the employer, which must be based on verified facts and respect the worker's right to give their account.
In development
The following are in development: a permanent indicator in the app showing the driver what is being recorded at each moment, a log of who viewed each driver's individual route that the customer can export, and encryption of the app's local database (currently protected by the Android system's own encryption). This document will be updated when they become available.
For the internal regulations, we provide the customer with a precise technical description of what each module captures, so that it can draft its clause based on real data and not on a rough idea.
05If you're a driver
- You have the right to know what is recorded about you, for what purpose, for how long and who can see it.
- You can request access to your data and a copy of it, including your positions and the proofs of delivery that involve you.
- You can request rectification of an erroneous record: a misattributed delivery, a misassigned workday.
- You can object to a treatment that exceeds the stated purpose.
- You can claim with the Personal Data Protection Agency, and with the Labour Inspectorate if the problem is of labour control.
The application goes to your employer, who is responsible. If you don't know who to address it to or you don't get an answer, write to [email protected]: we identify the person responsible and transfer your application within 5 working days, confirm that we did it, and we don't inform him anything beyond what is necessary to process it.
